These terms and conditions are intended to ensure that Haythornthwaite Wines remains a safe and trusted place to purchase wine. By using our website, you acknowledge that you have read, understood, and agreed to these terms and conditions.

SALE OF LIQUOR

Under the Sale and Supply of Alcohol Act 2012, it is illegal for us to sell wine to you if you are under the age of 18. It is also illegal for you to purchase wine from us if you are under 18 or to falsify your details in order to buy wine. We reserve the right to request additional age verification at any time.

PURCHASE TERMS

You are legally entitled to purchase alcohol (if applicable) and can provide sufficient evidence of that entitlement upon request (e.g., NZ Driver’s Licence or Passport) prior to or upon delivery.
All information supplied by you is true and correct at the time of purchase.
We reserve the right to refuse any order at our sole discretion.
We may disclose your information to your bank, credit card company, or for the purposes of any debt recovery proceedings.
We may impose a credit limit on your account, restricting your ability to purchase products.

PRODUCT AVAILABILITY

All products are sold subject to availability. Some promotional items may be limited in quantity. We shall not be responsible for any inability to supply products due to stock shortages or unavailability.

PRICING

Prices on our website are in New Zealand dollars (NZD) and include GST.
Full payment is required at the time of order submission.
Prices may change without notice. No adjustments will be made if a product's price increases or decreases between ordering and delivery.
Prices and promotions may differ between our Cellar Door, retail locations, and online store.
If a pricing error occurs due to a system issue, we reserve the right to require payment of the correct price before fulfilling the order.
There is no minimum order quantity.

SHIPPING

Freight is a flat rate of $15 for orders of 5 bottles or fewer.
Orders of 6 bottles or more qualify for free shipping within mainland New Zealand.
Additional charges may apply for delivery to locations outside mainland New Zealand (e.g., Waiheke Island, Stewart Island).
Orders are typically delivered within 5–7 business days. If delays occur, we will notify you.
Orders will not be shipped until full payment is received.
At present, we only accept orders for delivery within New Zealand.

PRODUCT AND PACKAGING GUARANTEES

If you are dissatisfied with your order or find the wine is not to your taste, we will replace any unopened bottles or credit your account. The purchaser is responsible for return shipping. Returns must be made within one month of purchase.
We insure our products until they are delivered to your address. We are not responsible for damage or theft beyond this point.
If your delivery is damaged in transit, we will replace it. Damage claims must be reported within 48 hours of delivery.
If your order is packed incorrectly, we will rectify the issue. Packing errors must be reported within 48 hours of delivery.
If you receive corked or faulty wine, we will replace it or issue a refund.

NOTICES

All invoices and notices will be sent to the preferred contact method you have provided. It is your responsibility to update your contact details as necessary.

PRIVACY AND SECURITY POLICY

We respect your privacy and are committed to protecting it. Our website and Haythornthwaite Wines emails may contain special offers and allow subscribers to purchase wine online. You may opt out of Haythornthwaite Wines emails at any time via the unsubscribe link in our communications. Your personal details (excluding credit card information) will be securely stored in our system. For more information, refer to our Privacy Policy.

CANCELLATION POLICY

Once an order is placed, it is final and cannot be canceled. However, wine may be returned under the terms of our 100% Guarantee.

SITE CONTENT AND INTELLECTUAL PROPERTY

All intellectual property rights related to the Haythornthwaite Wines website, including written, graphic, and other material, are owned by Haythornthwaite Wines, its licensors, and product providers. No part of these terms grants you a license to use our intellectual property. Any infringement will be enforced under New Zealand law.

JURISDICTION

These terms and conditions are governed by the laws of New Zealand and subject to the exclusive jurisdiction of the New Zealand courts.

AMENDMENTS

We may update these terms and conditions by providing notice via your preferred contact method. The amended terms will take effect as stated in the notice but no later than 30 days after notification.
